Lesson Summary

1) The Sharî'ah [Islãmic Legislation] came to preserve 5 things:

  • Religion

  • Life

  • Lineage

  • Intellect

  • Wealth

So the Sharî'ah lays out the measures we are to take to keep these five things preserved.

For Example:

In order for wealth to be preserved the Sharî'ah said the hand of a thief should be cut off in order to preserve wealth.

As for intellect, if someone drinks alcohol this would tarnish their intellect so the Sharî'ah has placed the measure to stop us from falling into demonising our intellect. Thus, the one who drinks alcohol the Sharî'ah prescribes 40 strokes of the cane for the one who takes alcohol.

2 ) The Jilbãb was legislated to preserve the honour of the woman.

Allãh mentioned:

O Prophet! Tell your wives and your daughters and the women of the believers to draw their cloaks (veils) all over their bodies (i.e. screen themselves completely except the eyes or one eye to see the way). That will be better, that they should be known (as free respectable women) so as not to be annoyed. And Allâh is Ever Oft-Forgiving, Most Merciful.

[Sûrah Al-Ahzãb:59]

As-Suddiy [May Allãh have mercy upon him] mentioned: The Fussãq [rebellious, evil-doers] want women to go out of their homes so that they can target them. But when they see women wearing the Jilbāb they leave them alone believing they are free. However, when they see a woman with no Jilbāb they will go to her assuming she is a slave girl and they will seek to harm her.

Therefore, the Jilbãb was legislated to preserve a woman's honour from evil men, so they don't have evil thoughts about her and harm her.

3) The Sharî'ah closes all doors to Zinã’.

Allãh (ﷻ) said:

وَلَا تَقْرَبُوا۟ ٱلزِّنَىٰٓ ۖ إِنَّهُۥ كَانَ فَـٰحِشَةًۭ وَسَآءَ سَبِيلًۭا

And come not near to unlawful sex. Verily, it is a Fâhishah (i.e. anything that transgresses its limits: a great sin), and an evil way (that leads one to Hell unless Allâh forgives him). [Sûrah Al-Isrã’:32]

The Scholars of Islãm generally mention a principle: The means to get to an intent takes the same ruling as the intent.

As a means of protection, Allāh commanded both the believing men and the women with lowering their gaze, so as to protect and purify the hearts of the believers. [See Sûrah An-Nûr:30-31]

Imām Ibn Al-Qayyim [May Allāh have mercy upon him] mentioned: the eyes, do to the heart what the arrow does to its prey. So, if the arrow doesn't kill its prey, it will at least injure it. (In the same manner,)if the eyes don't see what kills the heart it will at least injure it.

4 ) The Jilbãb was legislated to purify.

The Belief of Ahlul-Sunnah Regarding Êmãn: Êmãn increases when you obey Allãh and it decreases when you obey Shayṭān; so when Allãh commands with wearing the Jilbãb, and you obey, then this will bring about an increase in Êmãn.

It is from the Hikimah (Wisdom) of Allãh that no one gets close to Him except for the purest of people. So if you want to enter into Jannah (Paradise) you have to be pure, and this is evident because, on The Day of Qiyāmah, Allãh would either forgive a person's sins or He would punish the person so that they are purified from their sins before they are admitted into His Jannah.
